A few days ago, the British "Financial Times" reported that according to multiple people familiar with the matter, the US Department of Defense has decided to remove Hexai Technology from the "blacklist of Chinese military-affiliated companies" because the Pentagon believes that the world's largest lidar manufacturer for electric vehicles does not meet the legal criteria for being blacklisted.

For such cases, it seems that the micro semiconductor seems to have learned something.

China Micro Semiconductor Equipment (Shanghai) Co., LTD. (hereinafter referred to as "China Micro") announced on August 16 that it has formally filed a complaint in a US court to Sue the US Department of Defense's decision to include it in the list of Chinese military enterprises (hereinafter referred to as the "CMC List").

On January 31, the US Department of Defense included the company in the CMC list in accordance with Section 1260H of the National Defense Authorization Act for Fiscal Year 2021. The company firmly believes that the decision of the U.S. Department of Defense to include the company in the CMC list is wrong, inconsistent with the facts, without legal basis, and contrary to due process, which will have a serious impact on the company's reputation.

The company said that since being included in the CMC list, the company has made every effort to actively communicate with the US Department of Defense, clarify the facts, provide sufficient evidence to prove that it does not meet the identification criteria of the CMC list, and ask it to remove the company from the CMC list. However, unfortunately, as of the date of formal prosecution, micro and micro companies have not yet achieved their wish. Therefore, the company had to take legal channels and request the court to ask the US Department of Defense to revoke its wrong decision in order to eliminate misunderstandings, safeguard the legitimate rights and interests of the company, and protect the interests of the company's shareholders, customers and partners.

The company said that it has always adhered to legal and compliant operations, strictly abides by domestic and international laws and regulations, and has never participated in any military-related activities. On January 14, 2021 (US Eastern Time), the US Department of Defense had included the company in the list of Chinese military enterprises. After the company complained to the US Department of Defense with sufficient facts and evidence, the company was successfully removed from the list on June 3 (US time) of the same year.

Yin Zhiyao, chairman and general manager of China Micro Corporation, said: "We are deeply shocked that the US Department of Defense has once again included China Micro Corporation in the military list. This decision is wrong and baseless. We are confident that the court will make a fair ruling and remove the company from the CMC list. At the same time, we are willing to continue to maintain communication with the US Department of Defense to resolve the existing disputes amicably and properly."

According to public information, the company is committed to providing leading processing equipment and process technology solutions for global integrated circuit and LED chip manufacturers. The plasma etching equipment and chemical thin film equipment developed by the company are key equipment for manufacturing a variety of microscopic devices, and can process a variety of devices at the micron and nano levels. The plasma etching equipment of the company has been widely used in many etching applications of advanced processes of international first-line customers. The MOCVD equipment developed by the company for the production of LED and power device epitaxial sheets has been put into mass production on the customer's production line, and currently occupies a dominant position in the global gallium nitride based LED MOCVD equipment market.

It is worth noting that on January 14, 2021 (Eastern Time), the US Department of Defense had included the company in the Communist Chinese Military Companies List. After the company complained to the US Department of Defense with sufficient facts and evidence, the company was successfully removed from the list on June 3 (US time) of the same year.

Recently, Yin Zhiyao said: "In the past two decades, our autonomy and control process has generally progressed smoothly, and the autonomy and control rate of major components has reached more than 90%, and can reach 100% by the end of the third quarter of this year."
